These Terms of Service ("Terms") cover your use of the website and the services offered through it (the "Service"), operated by helpwithpropertymanagement.com ("we," "us," or "our"). Using the Service means you accept these Terms. If any part of them does not work for you, please do not use the Service.
1. Agreeing to These Terms
When you visit the Service, submit an inquiry, or otherwise interact with us through it, you confirm that you have read these Terms and our Privacy Policy, and that you agree to both. The Privacy Policy is part of this agreement. These Terms apply to every visitor and user.
2. What We Do, and What We Do Not Do
helpwithpropertymanagement.com is a marketing and referral service. We connect property owners who are looking for property management with independent, local property management companies ("Managers").
We are not a property management company. We do not manage properties, lease units, collect rent, handle maintenance, or provide any related service ourselves. Our job starts and ends with making an introduction between you and one or more Managers.
3. Who Can Use the Service
You need to be at least 18 and legally able to enter a binding contract. By using the Service, you confirm that both are true and that the information you give us is accurate and complete.
4. Submitting an Inquiry
When you send us an inquiry, you authorize us to pass along what you provided, including your name, your contact details, and information about your property, to one or more Managers so they can reach out to you about their services.
You are never obligated to hire any Manager we introduce you to. If you do hire one, that agreement is between you and the Manager. We are not a party to it.
You also agree to give us accurate and current information, not to submit an inquiry for someone else without their permission, and not to use the Service for anything unlawful or fraudulent.
5. Independent Property Managers
Managers run their own businesses. They are not our employees, agents, partners, or representatives.
We do not control, endorse, or guarantee any Manager's services, pricing, conduct, licensing, or qualifications. Whatever happens between you and a Manager — contracts, disputes, results — is between the two of you. We are not responsible or liable for what a Manager does or fails to do.
6. How We Are Compensated
We may receive a fee from a Manager when we refer you to them, or when a referral leads to a signed agreement. That compensation does not change what you pay the Manager, and we do not charge you for using the Service.
7. Calls, Emails, and Text Messages
By submitting an inquiry, you agree that we and the Manager or Managers we refer you to may contact you at the phone number, email address, and mailing address you provided. That includes email, phone calls, and SMS text messages, and it includes automated dialing or texting systems.
Agreeing to marketing messages is not a condition of buying anything. Message and data rates may apply.
To stop texts, reply STOP or UNSUBSCRIBE to the number that messaged you. We remove you as soon as the message reaches us. To stop marketing emails, use the unsubscribe link in any message. Managers handle their own opt-outs, so you may need to tell them separately.
8. Acceptable Use
Please do not:
- Submit false, misleading, or stolen information
- Submit inquiries for properties you have no connection to
- Scrape, crawl, or harvest data from the Service by automated means
- Try to break, overload, or gain unauthorized access to the Service or its systems
- Use the Service to send spam or to market your own products
- Copy or reuse our content for a competing service
- Use the Service in any way that breaks the law
9. Our Content and Trademarks
The Service, along with its content, features, and design, belongs to us and our licensors, and is protected by copyright, trademark, and other laws. Our name, logo, and trade dress are ours. Do not use them in connection with any product or service without our written permission first.
10. Links to Other Sites
The Service may link to sites we do not operate, including Manager websites. We do not control those sites and are not responsible for their content, terms, or privacy practices.
11. No Warranties
The Service is provided "AS IS" and "AS AVAILABLE," with no warranties of any kind, express or implied. That includes any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not promise that the Service will be uninterrupted, secure, or free of errors. We also do not promise that an introduction to a Manager will lead to any particular outcome, or to an outcome you are happy with.
Some states do not allow certain warranty exclusions, so parts of this section may not apply to you.
12. Limits on Our Liability
To the fullest extent the law allows, neither we nor our directors, employees, or affiliates will be liable for any indirect, incidental, special, consequential, or punitive damages. That includes lost profits, lost data, and lost goodwill, whether the claim arises from your use of the Service or from your dealings with a Manager, and whether it is framed as contract, tort, or anything else. This applies even if we were warned such damages were possible.
Some states limit how far these exclusions can go, so parts of this section may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless helpwithpropertymanagement.com and its affiliates against any claims, damages, losses, liabilities, costs, or expenses that come out of your use of the Service, your breach of these Terms, or your dealings with any Manager.
14. Suspending or Ending Access
We can suspend or cut off your access to the Service at any time, with or without notice, if we believe you have broken these Terms or if we are shutting down or changing the Service. We can also decline to refer any inquiry.
15. Disputes and Governing Law
These Terms are governed by the laws of the State of Utah, without regard to conflict of law rules. Any dispute that is not resolved otherwise goes to the state or federal courts located in Utah County, Utah, and you agree to that jurisdiction.
16. Changes to These Terms
We may update these Terms whenever we need to. When the changes are material, we post the updated version on this page and change the "Last updated" date at the top. Continuing to use the Service after that means you accept the new version.
17. Other Terms
Severability. If a court finds any part of these Terms unenforceable, the rest stays in effect.
No waiver. If we do not enforce a provision right away, we have not given up the right to enforce it later.
Assignment. You may not transfer your rights under these Terms without our written consent. We may transfer ours in connection with a merger, acquisition, or sale of assets.
Entire agreement. These Terms and the Privacy Policy are the complete agreement between you and us about the Service, and they replace anything said or written before.
